Validity of the Sales Contract, Product, and Price Information
The terms and conditions apply to purchases made in the Online Store.
The prices of products sold in the Online Store are indicated next to the products. Additional fees apply for delivery.
The delivery fee depends on the buyer's location and the chosen delivery method.
The delivery fee is displayed to the buyer during the checkout process.
Information about the products is provided directly next to the products in the Online Store.
The currency is Euro, and payment links are provided by Maksekeskus AS.
Ordering Process
To order products, add the desired items to the shopping cart. To complete the order, fill in the required fields and select the appropriate delivery method. Then the total amount will be displayed, which can be paid via a bank link or other payment solutions.
The contract comes into force once the payable amount has been credited to the Online Store's bank account.
If the ordered product cannot be delivered due to stock depletion or other reasons, the buyer will be informed at the earliest opportunity, and the paid amount (including delivery costs) will be refunded promptly, but no later than 14 days after the notification.
Delivery
Products are shipped to the following countries: Estonia, Latvia, and Lithuania.
The delivery costs are borne by the buyer, and the corresponding price information is displayed next to the delivery method.
Domestic deliveries in Estonia typically reach the destination specified by the buyer within 3-7 business days after the sales contract enters into force. Deliveries outside Estonia are completed within 30 calendar days.
In exceptional cases, the Online Store has the right to deliver goods within 45 calendar days.
Right of Withdrawal
After receiving the order, the buyer has the right to withdraw from the contract made in the Online Store within 14 days [depending on the products, the buyer might not have the right to withdraw. In such cases, the respective products and services must be listed, and they must comply with the conditions outlined in Section 53 (4) of the Law of Obligations Act].
The right of withdrawal does not apply if the buyer is a legal entity.
To exercise the 14-day return right, the ordered goods must not be used in a manner other than necessary to ascertain the nature, characteristics, and functioning of the goods in the same way as allowed for testing in a physical store.
If the goods have been used for purposes other than those necessary to ascertain their nature, characteristics, and functioning, or if they show signs of use or wear, the Online Store has the right to reduce the refund amount based on the diminished value of the goods.
To return the goods, a withdrawal form must be submitted to the email address: info@airsmile.ee no later than 14 days after receiving the goods.
The cost of returning goods is borne by the buyer, except if the reason for the return is that the goods do not correspond to the order (e.g., wrong or defective goods).
The buyer must return the goods within 14 days after submitting the withdrawal notice or provide proof that they handed the goods over to the carrier within that period.
Upon receiving the returned goods, the Online Store will refund the buyer immediately, but no later than 14 days after receiving the withdrawal notice, all payments received from the buyer under the contract.
The Online Store may withhold the refund until the goods forming the object of the contract have been returned or until the buyer provides proof that they have sent the goods back, whichever occurs first.
If the buyer explicitly chooses a delivery method other than the least expensive standard delivery method offered by the Online Store, the Online Store is not obligated to reimburse the additional cost.
The Online Store has the right to withdraw from the sales transaction and demand the return of goods from the buyer if the price of the goods in the Online Store was mistakenly marked significantly below the market price.
Right to File a Claim
The Online Store is responsible for any non-compliance or defects in the sold goods that were present at the time of delivery to the buyer and that become apparent within two years of the delivery. During the first six months,
the defect is presumed to have existed at the time of delivery, and proving otherwise is the responsibility of the Online Store.
The buyer has the right to contact the Online Store no later than two months after discovering a defect by sending an email to info@airsmile.ee or calling +372 5668 8887.
The Online Store is not responsible for defects that arise after the goods have been delivered to the buyer.
If goods purchased from the Online Store have defects for which the Online Store is responsible, the Online Store will repair or replace the defective goods. If the goods cannot be repaired or replaced, the Online Store will refund all fees incurred under the sales contract to the buyer.
The Online Store responds to consumer complaints in writing or in a form that can be reproduced in writing within 15 days.
Direct Marketing and Processing of Personal Data
The Online Store uses the personal data entered by the buyer (including name, phone number, address, email address, payment details) solely for processing the order and delivering the goods to the buyer.
The Online Store forwards personal data to transport service providers for the purpose of delivering goods.
The Online Store sends newsletters and offers to the buyer's email address only if the buyer has expressed a wish to receive direct marketing communications by providing their email address on the website and consenting to receive notifications.
The buyer can opt out of receiving promotional emails at any time by notifying the Online Store via email or by following the instructions in the promotional email.
Airsmile OÜ is the data controller, and personal data required for payment processing will be forwarded to the authorized processor Maksekeskus AS.
Dispute Resolution
If the buyer has complaints regarding the Online Store, they must be sent to info@airsmile.ee or call +372 5668 8887.
If the buyer and the Online Store cannot resolve the dispute by agreement, the buyer may contact the Consumer Disputes Committee.
